These Terms of Service ("Terms") govern your use of the Novaris website at novar-is.com and the design, hosting, and related services we provide ("Services"). By using our website or hiring us, you agree to these Terms. If you don't agree, please don't use our website or Services.

1About Novaris
Novaris ("Novaris," "we," "us," or "our") is a web design studio based in Leander, Texas. Where a separate written proposal or service agreement is signed between you and Novaris, that agreement governs the specific project; these Terms apply to everything else and fill any gaps.
2Our services
We design, build, host, and maintain websites and provide related digital services for businesses. The exact scope, deliverables, timeline, and price of any project are described in the proposal or quote we provide to you. Work not described there is out of scope and may be quoted separately.
3Quotes & proposals
Prices shown on our website are starting points and may vary based on your specific needs. A project is confirmed once you accept our written quote or proposal and pay the required deposit. Quotes are valid for 30 days unless stated otherwise.
4Payment terms
- Deposit. Unless we agree otherwise in writing, new projects require a 50% deposit to begin, with the remaining balance due before the finished site is launched or transferred to you.
- Method. Payments are made securely through PayPal (by card or PayPal balance). We don't store your card details.
- Late or missing payment. We may pause work or withhold delivery of final files and launch until outstanding amounts are paid.
- Taxes. Prices exclude any applicable taxes, which are your responsibility unless stated otherwise.
5The Care Plan
Our optional Care Plan is a monthly subscription covering hosting, updates, and small edits, as described at checkout. It is billed monthly through PayPal and runs month to month — you can cancel anytime, and cancellation takes effect at the end of the current billing period. We don't provide partial refunds for a month already started. If a Care Plan is cancelled or lapses, ongoing hosting and included edits stop, and you're responsible for arranging hosting for your site.
6Refunds & cancellations
Because our work is custom and time-based, deposits are non-refundable once work has begun. If you cancel a project mid-way, you're responsible for payment for the work completed up to that point, and any amount paid beyond that may be refunded at our discretion. Monthly Care Plan fees are non-refundable for the current period but stop future billing on cancellation.
7Your responsibilities
- Provide accurate information and the content (text, images, logos, etc.) we need, in a timely way.
- Confirm that you own or have the right to use any material you give us, and that it doesn't infringe anyone else's rights.
- Review and approve work when we ask; unreasonable delays may affect timelines and cost.
- Keep your account sign-in link private and let us know promptly of any errors or issues with your site.
8Ownership & intellectual property
You retain ownership of the content and materials you provide to us. Once your project is paid in full, you own the final website deliverables we create specifically for you. Until full payment, all work product remains our property.
We may retain and reuse general tools, code libraries, techniques, and know-how used to build your site, and we may display your completed project in our portfolio and marketing unless you ask us in writing not to. Any third-party components (fonts, plugins, stock media) remain subject to their own licenses.
9Third-party services
Our Services rely on third parties such as PayPal (payments), Cloudflare (domain and delivery), and email providers. Your use of those services may be subject to their own terms, and we're not responsible for their acts, omissions, or availability.
10Acceptable use
You agree not to use our website or Services to break the law, infringe others' rights, transmit harmful or malicious code, attempt to gain unauthorized access to our systems, or interfere with the operation of our website. We may suspend access for conduct that violates these Terms.
11Disclaimers
We take pride in our work and aim to deliver high-quality results. However, our website and Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that our website or your site will be uninterrupted, error-free, or free of every security vulnerability, or that specific business results (such as traffic, rankings, or sales) will be achieved.
12Limitation of liability
To the fullest extent permitted by law, Novaris and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of our website or Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the specific Services giving rise to the claim in the three (3) months before the claim.
13Indemnification
You agree to indemnify and hold harmless Novaris and its owners from any claims, damages, or expenses (including reasonable legal fees) arising from content or materials you provide, your use of the Services, or your breach of these Terms.
14Term & termination
These Terms apply while you use our website or Services. Either of us may end an ongoing engagement with reasonable written notice, subject to payment for work already done. We may suspend or terminate access immediately if you breach these Terms or fail to pay. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will continue to apply.
15Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Texas, and you agree to that jurisdiction.
16Changes to these Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date above and post the new version on this page. Your continued use of our website or Services after a change means you accept the updated Terms.
